According to legal documents obtained, explosionIn 2010, the “Watch What Happens Live!” host kept his promise to fight McSweeney’s claims in court: Cohen and the other defendants, through their attorneys, filed a motion to dismiss the former Bravolebrity’s lawsuit.

Andy Cohen asks court to dismiss Leah McSweeney’s lawsuit
McSweeney’s lawsuit names as defendants Cohen, producers, networks, distributors and certain individuals involved with “The Real Housewives of New York” and “The Real Housewives: Ultimate Girls Trip.”
The list includes Lisa Shannon, John Paparazzi, Darren Ward, Warner Bros. Discovery Inc., Shed Media US Inc., NBCUniversal Media LLC and Bravo Media LLC.
Through their lawyers, the defendants argued that McSweeney’s lawsuit should be dismissed for several reasons.
“Plaintiff seeks to overwhelm with her 754-paragraph complaint, but even a cursory review of her arguments reveals that many of them relate to matters entirely unrelated to her claim, and most are without factual or legal support, are speculative, and misleading. and/or This is clearly false.”

Cohen’s lawyers argued that many of McSweeney’s complaints were supported by “the most conclusive and stale allegations” and should be dismissed as a matter of law.
The former housewife’s other discrimination claims had to be dismissed for the following reasons:
“They seek to unjustifiably infringe on Defendants’ First Amendment right to tailor and tailor the message they want to convey in their creative works through casting choices and other creative decisions.”

Cohen’s camp denies McSweeney’s alcohol allegations
Cohen’s legal team came prepared to launch a series of fascinating attacks on McSweeney’s claims. First, they tackled the shocking allegation that the defendants influenced her relapse into alcoholism in order to win ratings.
The former Bravolebrity accused Cohen’s team of directing cast members to make nasty comments about her on camera and of barring her from future seasons of “RHONY” because they wanted to feature co-stars who drank alcohol.
However, the defense denies these allegations, arguing that even if true, they amount to “creative expression” and therefore McSweeney’s lawsuit should be dismissed under the First Amendment defense.

“Decisions about what to say or not say in a creative work, as well as ‘casting decisions,’ are an ‘integral part of the creative process,’ and therefore should be protected by the First Amendment from the application of anti-discrimination laws to that process,” Cohen’s campaign argued.

Defendants reject McSweeney’s discrimination claims
In her scathing lawsuit, Ms McSweeney accused Mr Cohen’s team of multiple offences, including sex and religious discrimination, but the defence pointed out that her sex-based claims only related to three incidents.
Those incidents included two comments Cohen allegedly made on-air during the “RHONY” reunion show in the fall of 2020, and one private text message Cohen sent in December 2020 in response to McSweeney’s social media posts.
Cohen’s defense argued that the alleged comments were time-barred by law, but that the text messages were “too trivial” to support McSweeney’s gender-based claims.
As for religious discrimination, she argued that the failure to offer any options other than pork at the event was insufficient to legally support her claim.
Amid legal drama, former housewife maintains her intentions were pure
Two months before Cohen’s camp dismissed McSweeney’s lawsuit, The Blast reported that she had addressed the unfolding drama. In a March interview, the former reality TV star insisted her intentions were pure, saying:
“It’s tough to compete, Very powerful Entities, and people, probably Also But I don’t care if people don’t agree with me, or if they attack me and I get hit back, or whatever, because this is the truth: I am on my side, and my intentions are Really good“
While McSweeney said she wasn’t concerned about people who disagreed with her, she admitted dealing with the backlash has been difficult.

“Even when you’re in a really good place, it’s still painful. It’s still not a fun experience having people attack you or dealing with the situation you’re in,” she lamented.
Andy Cohen previously threatened a defamation lawsuit
In March, The Blast reported that Cohen’s team had threatened to sue McSweeney for defamation, warning the former housewife to retract her false claims or prepare to face them in court.
“To be clear, these allegations are completely false. Mr. Cohen has never used cocaine with any Real Housewives cast members or any other Bravo employees,” the TV host’s lawyers argued in the letter.
“The truth matters. Lawsuits should not be used to create fake news or as a means to spread false and malicious lies to further extortion efforts,” they continued to warn.
“We demand that you immediately and publicly retract and apologize to Mr. Cohen. Each day that passes without you doing so will only increase the damage suffered by Mr. Cohen.”
